These Terms of Service (“Terms”) govern your access to and use of the MyAgentEstate website at myagentestate.com and the MyAgentEstate platform (the “Service”). By using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use the Service

You must be at least 18 years old. If you're using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Your account

You're responsible for safeguarding your password and for activity under your account.
You agree to provide accurate information when signing up and to keep it current.
One account per person. Sharing accounts across multiple brokers violates these Terms — instead, invite your team using the Team plan.

3. Subscriptions, trials, and billing

3.1 Trial

When you sign up, you receive a 3-day free trial. You provide a payment method at signup, but your card is not charged during the trial. On day 4, billing begins automatically at your selected plan rate. You may cancel at any time before day 4 to avoid charges.

3.2 Subscriptions

Subscriptions are billed monthly in advance. Plans:

Individual: $125 per agent per month
Team: $100 per seat per agent per month, requires 3+ brokers on the account
Managed Credits: $500 per person per month for a managed credit pool
Pay-as-you-go: usage-based billing for cost-bearing tools, with monthly invoices

Adding or removing agents adjusts your monthly bill on a prorated basis effective immediately.

3.3 Cancellation

You may cancel any time from your dashboard. Cancellation takes effect at the end of the current billing period. We don't offer pro-rata refunds for partial months unless required by law.

3.4 Failed payment

If a payment fails, we'll retry several times over 14 days and notify you by email. If payment isn't resolved, we may suspend the Service. Your data is preserved during suspension.

4. Acceptable use

You agree not to:

Use the Service to send spam, phishing, or unsolicited bulk messages.
Use the Service for illegal activity or to violate third-party rights.
Reverse engineer, decompile, or attempt to extract source code or model weights.
Resell, sublicense, or repackage the Service without our written permission.
Attempt to access another firm's data, bypass security controls, or interfere with the Service's operation.
Use the Service to generate content that violates fair-housing laws, makes false claims about properties, or otherwise breaks real-estate licensing rules in your jurisdiction. You're responsible for compliance with regulations applicable to your firm.

5. Your content and data

You retain ownership of all content you upload, generate, or configure on the Service (your “Content”). You grant us a limited license to host, process, and display your Content solely to operate the Service.

We do not use your Content to train any AI model. See our Privacy Policy for details.

6. AI agent outputs

Outputs from the AI agents are tools to assist your work, not legal, financial, or fiduciary advice. You're responsible for reviewing outputs before sending email, signing documents, posting listings, or making decisions based on them. The Service includes approval gates by default — keep them on.

AI outputs may sometimes be incorrect, biased, or inappropriate. We're continuously improving accuracy, but you should not treat any output as final without human review, particularly for regulated documents.

7. Third-party connectors

When you connect third-party services (Gmail, Zillow, etc.), you authorize us to access them on your behalf using your credentials. Your use of those services remains subject to their own terms. We are not responsible for changes, downtime, or data losses on third-party platforms.

8. Termination

You may terminate your account at any time. We may terminate or suspend your account for violation of these Terms, non-payment, or prolonged inactivity, with reasonable notice unless the violation is severe.

After termination, your data is retained for 90 days for recovery, then permanently deleted unless legal obligations require longer retention.

9. Service availability

We aim for high availability but do not guarantee uninterrupted Service. We may perform maintenance, deploy updates, or experience outages. See our status page for current Service health.

10. Disclaimers

The Service is provided “as is”without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the fullest extent permitted by law, MyAgentEstate's total liability arising from or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim. We're not liable for indirect, incidental, consequential, or punitive damages.

12. Indemnification

You agree to indemnify and hold MyAgentEstate harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your Content, your use of the Service, or your violation of these Terms or third-party rights.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email and a notice in the dashboard. Continued use of the Service after changes take effect means you accept the new Terms.

14. Governing law

These Terms are governed by the laws of the United States and the state where MyAgentEstate is registered, without regard to conflict of laws principles. Any dispute must be resolved in the state and federal courts located there.
